Casey Anthony Defense Files New Motions

Casey Anthonys Defense team filed new motions today to have Caseys indictment, death penalty and some of the check fraud charges dismissed.
In the motions they argued that the indictment against Casey Anthony included no facts upon which the charges were based.  They are requesting that Judge Strickland dismiss what they call a “defective indictment”.

The defense team claims that there are no facts to refute in the indictment so they are unable to formulate a defense.  They also claim that prosecutors are just on a fishing expedition.

Regarding the check charges, there are currently 3 charges for each of 4 checks Casey alegedly wrote from her friends checkbook.  Defense claims this amounts to double jeopardy and these extra charges should be dismissed.

Casey complaint against Jose Baez

Anthony family Private Investigator Dominic Casey had filed a complaint against Jose Baez with the Florida BAR claiming that Jose Baez had told him not to call 911  if he found the body of Caylee Anthony.
Dominic Casey is the PI that was filmed by Hoover searching the area where Caylee Anthony was eventually found months later.
The procedure for complaints with the BAR is to first examine complaints at the “staff level”.   From there, if the complaints are not dismissed they are escalated to grievance committee.  Which is now where this complaint against Baez is.
The grievance committee is a made up of attorneys and  private citizens that investigate the charge to determine if there is probably cause that a bar ethics violation occurred.
If they find that to be the case the complaint will then graduate to the disciplinary process. (source)

Qualifications for an Attorney to try a Death Penalty Case in Florida

Since the Death Penalty has been put back on the table in the Casey Anthony case there has been much speculation on who will be the new attorney in the case.

Previously Miami attorney Terence Lenamon, was the death qualified attorney but was removed from the defense last October when the state took the death penalty off the table.

Baez’s spokeswoman, Marti Mackenzie, had this to say about a court appearance scheduled for later this month

“At that time, the defense will introduce the highly qualified and outstanding death-qualified attorney as the newest member of the defense team,”

Which is all well and good, but if that’s the case what are they doing deposing witnesses without him right now?

There’s been speculation as to the “qualifications” of an attorney in the death penalty cases.  In all the stories I can find they just kinda dance around it.  Here are two of them:

During JVM earlier an attorney said what everyone is referring to is in the Florida Rule of Criminal Procedure and that it doesn’t actually put requirements on attorneys unless they are court appointed attorneys, and that if Casey has chosen Baez, then the rule is irrelevant.

Not sure about all that, it’s a little out of my jurisdiction.  One of you attorney’s chyme in here an let me know.

In Defense of Casey Anthony: Legal Team for Casey With Greta ‘On the Record’

GRETA VAN SUSTEREN, FOX NEWS HOST: Tonight: He has direct access to Casey Anthony, and now you have direct access to him. Casey Anthony sits behind bars tonight, charged with her daughter, Caylee’s, murder. Casey Anthony’s lawyer, Jose Baez, joins us. Welcome, Jose.
GRETA VAN SUSTEREN: Jose, there are all sorts of different types of clients. There are some who just tell the lawyer, Just go ahead and do your work. There are some who are much more involved in their case. I mean, how do you describe her as a client?

BAEZ: Well, she’s very involved in her case, and I — but that’s not just her. I try that with all of my clients. I think, first of all, the one knows the most about their case is them, and I try to educate them on a constant basis to — so that way, they’re familiar with the process and they understand what it is that I’m trying to do for them, and that usually makes my job a whole lot easier.

VAN SUSTEREN: How did she take the fact that the police at least suspect — or sheriff’s department — that the bones, the skull they have found belongs to her daughter? I mean, is she just standing by and waiting for the news, or does she say anything about it? What — how’s she taking that?

BAEZ: Well, you know, as far as real detailed specifics, I know you’re doing the best you can to get it out of me, but I have to tell you I have decided to try and keep a lot of that confidential because it’s her privacy that I want to respect. And this is happening to her and her life, and as her attorney, I think that’s just the right thing to do.

VAN SUSTEREN: All right. You should know I’m sort of carefully avoiding invading the attorney-client privilege and sort of just getting sort of, you know, your perceptions of her, not asking what she said, but – - all right, the search that’s going on right now — and yesterday in court, the other day, they mentioned a little girl’s bones or something. Can you give me any sort of background information on that and what you know, whether or not this is Caylee or not?

BAEZ: Well, I — you know, that came out with the media, and the very first thing that I thought was, Oops. They have been keeping everything close to their vest. That was what the Orange County sheriff’s office attorney said. And then the sheriff’s office later went on record and retracted that statement.

What our experts are telling us is that it takes two to three days to get a DNA match, and we’re going up on one week now. We have — you know, we’re doing everything we can to move this process along quickly. So as far as what I know, it’s been based on certain conversations, but pretty much everything that’s out there is what I know right now.

VAN SUSTEREN: You don’t represent the parents, do you, Jose? You just represent Casey?

BAEZ: No. They have a very good attorney named Brad Conway (ph) that is representing the family at this time.

VAN SUSTEREN: All right. The reason why I wanted to establish that is that, you know, we hear all sorts of, you know, rumors, as you might imagine, and one of them is that the parents are at risk of being charged themselves. Do you have any — I mean, are you hearing that at all? The prosecution — are they making those threats?

BAEZ: Well, you know, you hear rumors all the time. And I’ve got to tell you something, Greta. What’s been going on in this case is unlike any case I’ve ever seen and many other attorneys that I’ve spoken to have ever seen. The rumors just run are rampant, so you really don’t know what to believe and it’s very hard to tell fact from fiction in this case. And that’s — that’s been the battle that I’ve had to deal with from day one, is that I have this very unpopular client, and many things are being thrown out there, and it’s impossible to respond to every single allegation, every single rumor.

VAN SUSTEREN: Is there any chance in your mind the case will be tried in Orlando, or are you going to have to move it out of there? And I mean, I don’t know if even moving it can change the issues associated with change of venue, but do you really expect that one to be tried in Orlando?

BAEZ: Well, we certainly hope not. We’ve given the prosecution our motion for change of venue. They’re looking it over. I believe we’ll be having a hearing on that shortly. And we’ve laid out a specific place where we feel it’s best to do this trial at. I have not disclosed that location, and I’ve asked that we — I’m trying to see if we can keep that confidential, so that way, it doesn’t spoil that market by pre-trial publicity. So that’s the way — that’s the route we’re going to take. We’re going to ask that it be held confidential so it doesn’t taint any prospective jurors in that specific area. And we’re certainly hoping we can get it moved there.

VAN SUSTEREN: Well, I’ve been down there and I’ve seen it, and I’ve even been part of the media coverage, as you well know. And I think that this is one case that needs to be moved someplace in all fairness to all the parties.

BAEZ: Absolutely.

VAN SUSTEREN: Thank you, Jose.

Baez Lashes Out At Investigators

untitled3On Wednesday Casey Anthony’s attorney Jose Baez released the following statement regarding the crime scene:

“The Casey Anthony Defense Team has made numerous attempts to preserve the evidence in and around the location where the human remains of what appear to be a small child were found.

Law enforcement has been repeatedly asked to allow reasonable access by medical and scientific experts for the defense, including requests for photographs, and assistance with maintaining a secure examination scene prior to any media or general public access.

Every effort by The Baez Law Firm to establish a level of basic cooperation and professional courtesy have all been rejected by the government. This lack of cooperation has complicated how to proceed.

Now that the scene more resembles that of an excavation site as opposed to an examinable crime scene – attorney Jose Baez has been advised that without properly detailed photographs and all related material and documentation, the various experts on the Casey Anthony Defense Team will simply not be able to thoroughly examine the site.

Unfortunately this matter has already become a Media Circus and something The Baez Law Firm will not contribute to, by just making a show of going to the excavation site without good reason. The Casey Anthony Defense Team is being prevented from examining the site unless and until all photographs, schematic sketches and related material and documentation are released to the defense through the discovery process.”

Open Thread For Emergency Motion Hearing

photo_servlet7ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) — Judge Stan Strickland of the 9th Judicial Circuit Court will hold an emergency motion hearing Tuesday at 2 p.m. at the Orange County courthouse.

The hearing is in reference to motions filed by Casey Anthony’s defense attorney, Jose Baez on Tuesday December 15, 2008.

Judge Strickland will rule on the following: emergency motion to compel photographs, video recordings and schematic drawings taken at the crime scene, continuing request for second autopsy and all related materials, emergency motion to preserve forensic evidence and appoint forensic expert for the court.

FBI Processes Evidence In Caylee Anthony Case

1-agrgatty1Cindy and George Anthony are at home on Hopespring Drive this afternoon after attending Sunday services at Eastside Baptist Church.

FOX 35 was the only crew at the Conway Gardens Road Church this morning, where the Anthonys’ pastor prayed for hope.

This afternoon the family’s attorney Brad Conway and Casey’s lawyer Jose Baez are inside the Anthony home, which investigators declared a crime scene earlier this week after a child’s skeleton was found Thursday less than a half mile away.

The scene where the bones were found on Suburban Drive remains active today, with FBI investigators combing the woods for a fourth day.

Official sources confirm some evidence has already been sent to the FBI lab in Quantico. While investigators won’t say exactly what evidence the FBI is processing, they say the majority of evidence will be sent after they conclude their search of the woods.

Although law enforcement previously expected to be finished searching the area today, officials now say there is no timetable set.

Detectives are they’re tight-lipped on whether any more evidence has been found.

On Thursday, a utility worker found a child’s skull around the corner from the  home of Caylee Anthony, who was two when she went missing in June.

Her mother, Casey Anthony, waited a month to report her daughter missing and has been charged with murder.

Orange County Sheriff’s deputies and the FBI are still combing the area where the skull was found. Orange Sheriff’s spokesman Carlos Padilla wouldn’t say what else has been recovered.

On Saturday, Anthony’s lawyer and his forensic investigators conducted their own investigation at the Anthony family home.

Casey Anthony’s Attorney Requests Mall Video

1-22Eyewitness News has learned that Casey and her defense team are asking a judge to force a Central Florida mall to turn over video from a security camera. 

Jose Baez wants to get access to video from the Florida Mall that was recorded on November 16, the day someone reported an alleged Caylee sighting inside the mall.

 The State Attorney’s Office released Baez’s application Wednesday that was filed two days prior. The Florida Mall has refused to release the video.

Anthony Defense Team Leaves Discs Full Of Tips

1-abaezctr5Although Casey Anthony’s family and her lawyers claim her missing daughter Caylee is alive, information that could help find her has been abandoned at the Orange County Sheriff’s Office for an entire month.

 Anthony’s attorney, Jose Baez, went to court demanding access to those tips but he hasn’t examined them yet. Casey Anthony is charged with murder in connection with the child’s death although her body has not been found.

 On November 5, 2008, Baez said, “We all believe she’s alive and if these tips, if there’s one credible tip in that 5,000, it’s worth us going through them.”

 He’s received repeated reminders that the tips, which took 50 hours and $980 to compile, were ready for him to pick up.

 Baez filed a court motion asking for “any police investigation reports or any other similar documentation… Which involves the investigation of tips, leads and follow-ups… On sightings of Caylee.” Baez’s spokesman says the Sheriff’s Office has misled them in the past, implying the abandoned discs don’t contain tips of Caylee sightings. He said that even though the defense hasn’t looked at them yet. He also said that Baez “could maybe already know what’s on those discs.”

 The Sheriff’s Office offered to let the defense team look at all the tips it wants after it’s paid for the work that’s already been done. So far, Baez has not done that.

 Baez is scheduled back in court Thursday for a pre-trial hearing, on Casey Anthony’s murder charges.

ATTORNEY WITHDRAWLS FROM CASEY ANTHONY CASE

Another attorney withdraws from the Caylee Anthony case! This time it’s a member of Casey Anthony’s defense team. Terence Lenamon was brought on by Jose Baez to assist in the death penalty portion of the tot mom’s trial, expected to begin January 5. On Friday the State Attorney’s Office announced that they will no longer be seeking the death penalty against Casey Anthony, so Lenamon assistance in the case is no longer needed.

Expert working with Casey Anthony attorney Baez expects trial to be delayed

ORLANDO, FL — A member of the Casey Anthony defense team believes her January trial will be delayed.  Dr. Lawrence Koblinsky made the prediction Monday night on on CNN’s Nancy Grace Show.

Dr. Koblinsky, is a forensic scientist whose main area of expertise is DNA evidence.  He was recruited as an expert witness several months ago by Anthony attorney Jose Baez.

The murder trial is set to begin January 5th.  But Dr. Koblinsky says it may take at least an extra month for defense lawyers to prepare for trial.

In an earlier interview on the Nancy Grace Show, Dr. Koblinsky talked about why he joined the Casey Anthony defense team.  “To Mr. Baez I think he, as a good defense attorney, is entitled to know what the science says. I don’t make things black white, white black.  But I have to give him the best that science can offer,” he said. (source)
