ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) — Judge Stan Strickland of the 9th Judicial Circuit Court will hold an emergency motion hearing Tuesday at 2 p.m. at the Orange County courthouse.
The hearing is in reference to motions filed by Casey Anthony’s defense attorney, Jose Baez on Tuesday December 15, 2008.
Judge Strickland will rule on the following: emergency motion to compel photographs, video recordings and schematic drawings taken at the crime scene, continuing request for second autopsy and all related materials, emergency motion to preserve forensic evidence and appoint forensic expert for the court.

youngmom – those are all things that are protocol at a crimescene……. since Baez was not allowed at the crimescene, nor his experts, he wants things things in order to see what the crimescene looked like – before it was destroyed in the investigation. does that help?

Jose Biaz is such an idiot. There is absolutely NO precendent for the defense team to have access to a crime scene. Where does he even get that from?
The thing is, he is treating the police/FBI as part of the prosecution team… but they’re *not*. They are an independent third party who are gathering evidence, which will then be offered up for interpretation by the prosecution and defense.

Motion to Compel is basically to request the court to order the opposition to take some action. In this case, provide evidentiary items.

Well, from what they’re saying it sounds like they won’t release it period until they’re finished processing it, regardless of whether the remains have been identified.
Does the prosecution have access to the crime scene? I wasn’t under the impression that they did, and if so, I can see why that might be unfair.
I work for a law firm. They don’t have any legal right to any of the evidence until it is declared Caylee.
To my knowledge, the prosecution wasn’t there excavating the crime scene either and members of the prosecution aren’t at the FBI lab, etc.
AWL – the prosecution only has access, because it is a crime……. regardless of who it it – the prosecution would have access to the evidence collected…. it’s that way in Mass. anyway – I know Florida has a variation of some of our laws, but I think this is the case anywhere…

If you want to be a competent defense counsel I can’t condone you interfering with a murder investigation. Not verbatim-but in a nutshell what Strickland just said.
What is the point of the defense worrying about bone loss during the ID process, etc.? If it’s unavoidable, it’s unavoidable, but the bones have to be identified, otherwise there is no point for them to see the crime scene/evidence if they don’t even know if it’s Caylee.

I love that Strickland pointed out that the reason the crime scene hasn’t been released yet is because they ARE being methodical, and that if they weren’t being methodical we’d have the defense complaining that the crime scene investigation was sloppy. Bombshell~I believe that’s correct. The remains released to next of kin once identified. Then they have to give the defense the ok to do a second autopsy. In this case, the remains would not, in a sense, be “released”, but transferred from Qantico back to a Medical Examiners office, most likely not the one in Orange County.

Stricklands is doing ok I think—says Baez’s motion is basically asking him to order them to be allowed to interfere with a police investigation. Exactly right.
What if he let them in there and then it turned out not to be Caylee—-at that point no one would be able to be held responsible for that childs murder because Baez’s team was allowed to trample all over the scene.
Don’t get me wrong—I definately think this is Caylee—but LE has not realeased the DNA results to confirm it.
I think it took a long time for him to pass the bar. Baez was out of Law School for awhile before he was licensed, I believe.

I know this isn’t “thread related” but, you all seem pretty knowledgable about this case. In the beginning, there was a report of a “smell” in the woods near the school and it was investigated. Is the area where the remains were found in that area, or are there other woods nearby?

That is not what I gathered at all. The reporters asked Conway, the new attorney for the Anthony’s, how the house was left and he replied that it was a mess.
He also stated that they understood why this happened and that it was treated respectfully by LE.

I do think that he is trying to get back some of the items that were taken. Maybe they would like to vaccum the home.

tru-tv’s commentors said that Judge Strickland could have seen what these motions were about and denied the hearing. He sure is nice to the defense to let them have their say anyway. I wonder if the Judge knows that Baez accused him of obstruction of justice because of his last ruling on Baez’s motions? I hope this Judge will decide to stay with the case.

OJ was acquitted back in the day that DNA evidence was new and not many people understood it. Only scientists and medical people did. Today is different, people understand DNA much more.

Curious Dee, I am no legal eagle, but, when she was first brought on they reported that she had filed the appropriate papers to be allowed on the case. I’m paraphrasing but—sounded to me like she had to get permission from the courts. Anyone else know the text book answer for this?

I loved Judge Stricklands statement that these motions today were an attempt to interfere with a murder investigation. He has common sense, and that is a quality lacking in the defense team. Perhaps there should be a write-in poll to choose a nickname for this team of goofballs.

ET confirms that police are about to announce they are closing the case of John Walsh’s six-year-old son, Adam Walsh, who was found murdered over 25 years ago in Florida.
Law enforcement of Hollywood, Florida is expected to identify Ottis Toole as the killer, local CBS4 news reports.
Toole died in prison in 1996 and had confessed twice to the crime but then retracted his statements.
In 1981, Adam Walsh was taken from a department store when he stepped away from his mother to play a video game. Two weeks later, his severed head was found in a canal in Vero Beach.
The national attention of the case led to John Walsh hosting the television show “America’s Most Wanted.”

I have always been curious, at what point did KC tell CA that ZG was babysitting for her? KC claimed that ZG had been her nanny for about 1 year or so. Has CA confirmed this? Has KC been talking about ZG for the past year and a half or did ZG’s name come up just after Caylee went missing? I am confused. Can anyone help me on this issue, please?!
Also, I find it hard to believe that CA believed that there was a nanny. I mean, c’mon, as much as CA did for Caylee she at some point would have picked Caylee up from ZG’s or dropped her off. Especially when KC was “supposedly” working all of those late hours.
I know that there was never a ZG as a Nanny but I just find it hard to believe that CA would believe KC on this issue or even bring it up to LE. That’s why I think CA & GA are hiding something. It just doesn’t make sense to me.
Atty’s have to be licensed in the state that they wish to practice in. In the recent OJ trial his atty from Florida was in the process of getting his license in Nevada so he could represent him.

The appeals the defendants are entitled to are just too overrated in my opinion, especially in a case where the evidence is overwhelmingly obvious as to the defendan’ts guilt. If it was up to me I wouldn’t kill Casey right away. I would play with her first. Kind of like Russian Roulette . . . instead of a weapon though, I would use a chloroform-soaked rag. Every night I would bind her arms and legs with duct tape and put her into my car trunk. And every night there would be a different amount of chloroform on the rag that I’d tape to her face. So every night as mommy drifted off to dreamland she would wonder if this night would be a fatal dose or just enough to make her sleepy. For background audio I think I’d like to just loop the sound of Caylee’s voice over and over.
Anyway, fantasy aside, I hate Dr. Henry Lee. To find out today that his work for the Anthony’s is pro bono disgusts me. I’m sure there are plenty of innocent, low-income people that would benefit greatly from his services but he has decided instead to support a baby-killer. I e-mailed him also to tell him how disgusting he is.

If she did life she would only adjust and carry on like it was no thang. She gives moms like me a bad name..I am the same age as Casey and I don’t even drink let alone go out and party every night. My children are my life and it’s wonderful. My mother takes my children for 2 nights every month and I miss them every second. my kids are 28 and 26, they have never had their butts whipped. the have never been slapped, or told they were accidents or degraded. positive parenting.. and my son who has 2 boys is continuing with those same parenting skills.. he believes in time out.. and he believes in talking to his boys about the wrong they did.. the youngest is 3.. sad. that some people cant bring themselves to spank their children then there are those out there who kill them? oh my god, that baby didnt ask to be brought into this world.. she was a gift.. and they took that gift and placed it in the trash.. i cant imagine. that is why i have followed this case so close.. it is beyond belief to me..

Anyway, after all this time and all these different versions, Casey’s finger prints should not be anywhere on any of the evidence found with Little Caylee’s remains because after all Zeneida killed Caylee…….yeah right, I wouldn’t believe that “for all the tea in China”…

I am envisioning Casey cooped in her 7×12 ft cell for 23 hours a day. Since these remains have been found.. I bet she is having anxiety attacks. Have you ever gotten so upset over something, that you just want to get in the car and drive…. or go for a long long walk? Can you imagine KC being stuck in a cell, no one to talk or vent to? She certainly cant vent to her atty, or he would have no defense.
I am loving the vision….. she has to be miserable. The only thing missing is some of those utube videos that have memorialized Caylee……. with the sad music that makes anyone cry.
The SA chose not to go for the death penalty because their case was entirely circumstantial. A jury that is looking at circumstantial evidence is less likely to convict a person when DP is a possible sentence. The SA wanted to make sure they would have a conviction.
Don’t be surprised that once the cause of death is determined and the remains are identified that the SA doesn’t put DP back on the table.

I completely agree with your parenting style tamie! Kudos to you and I’m sure your children are lucky to have you!! I just don’t understand how there are moms like me and you that strive to be the best mother that they can be to their children and then there are the Casey’s of the world that are to wrapped up in partying and drugs to even care for their own child. I’ve just been going over all the messages KC sent to Tony L in May. It goes on forever and she is always telling him she is waiting for the nanny or working, but she wasn’t right? What was she doing during that time? He mentions only seeing her once in 3 weeks and clearly he wants to be her boyfriend but only if he can see her more. He mentions that they live in the same city and he sees his parents more than her.

But I would love to see it dangling above her head. Justice, you do make a great point about it putting Baez in the 2nd seat. The police have a job to do and do not need 10 other people there scrunitizing their work. The work they have to do is extensive and exhaustive. Henry Lee and the queen botox Baden and others are there so they can write a book on the trial and make money.
But I predict when all the evidence is brought to light, many of these people will not be around. They will have Casey fingerprints all over the evidence. They have a mountain of evidence against her, much of which the police have not released….which is how its supposed to be done.
This is a easy case for the prosecution believe me. They are doing things by the book.
It was a good move by the police to not readily say it was Caylee so that they money mongers won’t mess up there crime scene.
There is no doubt that Casey buried her further in the woods and the tropical storm waters brought her closer.
The famed forensic “Fantastic four” defense team can say whatever they like because right now, as I write this, that baby is speaking to EVERYONE!
NO ONE in that family will fight for justice for her, not even her own drugged up grandparents, but SHE HERSELF IS! I guarantee you that!

Without OFFICIAL confirmation that this is indeed Caylee, Baez obviously KNOWS it is since he is filing all these motions. Casey flipped out for the FIRST TIME once this particular discovery was told to her so I think we can assume she knew it was Caylee. Bottom line: until a definite ID has been made the defense has no right to get involved. I would never hire Baez!
And now the Anthonys are flipping out because they too know it is Caylee and are trying to cover their rears with immunity. Why? Were they LYING all along?
