Judge denies request to stop evidence testing

Orange Circuit Court Judge Stan Strickland just gave Casey Anthony’s defense team a mixed bag.
Strickland denied a request from Anthony’s attorney, who wanted to stop evidence testing.

The state does not have to stop handling and analyzing forensic evidence, Strickland wrote in a two-page decision.

“The court knows of no authority or logical reason why the state should be prevented, even temporarily, from further analysis of relevant evidence,” he wrote.

The defense’s request to be notified of any further testing was granted.

Anthony, who is charged with first-degree murder in the death of her daughter, Caylee Marie, can have her own expert present to view and document the manner of the examination.

“The right of the defense expert to be present at any further testing does not include the right to interfere with . . . or even comment on the testing procedures as they occur,” Strickland wrote.

The state also must make every effort to keep a large enough sample of any items tested so the defense experts can conduct their own test.

    That is GREAT news. There is only one reason the defense would want the testing stopped and that is that they are afraid of what will be found. And I think it is funny that defense expert can be there but not participate or make any comments. And with the judge ruling that he can be present there is not balance to later say the testing was mishandled because their expert watched.

    The only hope in CA;s defense is for them to bring doubt to the validity of the testing procedures, thus invalidating the results. They are going to use Dr. Koby for this and I can just imagine what he will say He has already been questioning their “cutting edge” technology in their forensic analysis. Because it is new and uncharted territory, he will say that it is not valid. I just hope the jury does not buy it

    I really dont think the judge could or would have stopped the testing that would hender the case the state has againest Casey. JB was just making motions to do all he could and hoping.

    Someone has to be on the side of this poor child. Let’s find her and let there be justice done, whatever it maybe. Casey, sure doesn’t seem to care about only herself. Keep investigating all possible leads no matter what they will be. Don’t stop anything until she is found.

    I can just hear the defense at trial regarding evidence:

    Bozo: Mr. Kobalinsky…Is it not true that when you, in fact, conducted your own testing on the hair samples found in the trunk, which the prosecution identified as human post mortem, are, in fact, nothing more than hairs from a dead squirrel tail??

    I have to agree with you. We have evidence that a dead body the size of Caylee’s was in Casey’s trunk. Her hair was there which tests show are post mortem. However still, that is not hard evidence. It is not definitely from Caylee, or at least with the test results it can be argued that it might not be Caylee’s. Even though the chance that Caylee is alive might only be 1%, I certainly would not give up the search for a living child…not until there is hard evidence. I completely understand the grandparents feelings, even though they are grasping at a single straw of hope. I can’t blame them.

Okay, let me get this straight, bozo has to come out and do a PR statement to refute what his PR person stated…………….. it’s toooo funny watching them trip all over themselves…………it’s a shame they can’t keep their lies straight like Casey does, they need to take lessons off of their client ……….Question; is the defense team already working on an appeal, as in NOT QUALIFIED, before she is even convicted of murder because they know their defense is totally hopeless????

    Dont forget Tim Miller said that ” yes” he will still search for Caylee now more than ever and that he expects the biggest turn out of searchers ever… That is great to hear from he his such an ecpert in his field

    ok has anyone watched the interview with biaez from this moring? i just did and its again riducalous how he goes on and on about how caylle is alive and there close to finding her? this will be there defense and i hope Tim Miller finds this baby so she can be buried and casey can be punished.

    Even if a client is innocent, the defense should have their butts on top of all evidence testings. And, yes, they should still look for a “live” Caylee until her body is found or when Casey gets life/DP for her death. This way the defense can’t say that LE quit following on leads ( of which 95% came from Cindy).

    lindaOz … I understand that the Anthony’s are having a hard time letting go …. if they give up and say yes Caylee is dead … then they will have to agree that Casey killed Caylee and then they have not only lost both girls, they have been a major part of the cover up, the obstruction of justice and that they contributed greatly to Caylee being missing for 100+ days.
