Judge denies request to stop evidence testing

Orange Circuit Court Judge Stan Strickland just gave Casey Anthony’s defense team a mixed bag.
Strickland denied a request from Anthony’s attorney, who wanted to stop evidence testing.

The state does not have to stop handling and analyzing forensic evidence, Strickland wrote in a two-page decision.

“The court knows of no authority or logical reason why the state should be prevented, even temporarily, from further analysis of relevant evidence,” he wrote.

The defense’s request to be notified of any further testing was granted.

Anthony, who is charged with first-degree murder in the death of her daughter, Caylee Marie, can have her own expert present to view and document the manner of the examination.

“The right of the defense expert to be present at any further testing does not include the right to interfere with . . . or even comment on the testing procedures as they occur,” Strickland wrote.

The state also must make every effort to keep a large enough sample of any items tested so the defense experts can conduct their own test.

Baez: “Comments were taken out of context

Casey Anthony’s attorney Jose Baez says a television network took his firm’s spokesman’s comments out of context to make it appear he said  Caylee is deadSpokesman Todd Black said he never told Headline News that 3-year-old Caylee Anthony is dead. Black said Thursday the attorneys for her mother, Casey Anthony, believe Caylee is alive. A body has not been found.The network interviewed Black on live TV Tuesday and repeated part of the interview Wednesday. Headline News stands by its report. It says the transcript shows Black said “this is a very serious case involving not just the loss of the life of this little girl but the loss of whatever is going to happen with Casey Anthony.”

Few Women Face Execution — But Will Casey Anthony?

Prosecutors say Casey Anthony killed her child, but will they push to send her to death row? First-degree murder is punishable by death, but the history of female killers executed in Florida during the past 150 years is brief.

The state has executed only two women in the modern era. The third, a slave who killed her master, was hanged in the mid-19th century. Of the nearly 390 people on Florida’s death row, only one is a woman.

Only 1.5 percent of death-row inmates nationally are women, said Richard Dieter, executive director of the nonprofit Death Penalty Information Center. But most of those 51 women killed someone they know: a husband, boyfriend or their own child, he said.

The decision to seek the death penalty often is tied to politics and community outrage rather than the heinousness of the homicide, Dieter said.  Even so, though the Anthony case is the kind of crime that shocks the public, “many women have killed their children and don’t get the death penalty,” he said.

Randy Means, spokesman for State Attorney Lawson Lamar, said Wednesday that he could not discuss prosecutors’ plans for Anthony. But he did say they will make a decision in the next few weeks.

Florida law lists a number of “aggravating circumstances” that can be cited to justify execution, such as whether the homicide was committed in a cold, calculated and premeditated manner.

They’ll look at the mitigating circumstances — also outlined in state law — such as whether the defendant acted under extreme duress. In the end, it comes down to whether the aggravating circumstances outweigh the mitigating.

“It’s like doing math without numbers,” explained Bob Dekle, a retired prosecutor who teaches legal skills at the University of Florida.

George Anthony Denies Baez Spokesman’s Claim That Caylee Marie Is Dead

 

 

Casey Anthony’s attorney will hold press conference today

 Todd Black said defense attorney Jose Baez will hold a press conference at his Kissimmee office at 2 p.m. today. The subject of the press conference was not announced.

George Anthony remains hopeful granddaughter is alive

A solemn George Anthony denied this morning that his granddaughter Caylee Marie is dead.

Anthony was greeted by reporters as he left his house to tow a giant billboard of his missing granddaughter around Central Florida. Hours earlier while giving an interview on a live national news show, a spokesman for his daughter Casey’s legal team said the girl was indeed dead.

“It’s not a belief that I have in my brain,” Anthony said, when asked about the spokesman’s comments. “I don’t believe 99 percent of stuff that is out there.”

He refuses to give up hope that his granddaughter is alive somewhere.

“What would you do if this ever happened to you, to your family?” he asked. “Would you ever give up? No. Would you ever stop? No.”

Comment was edited, defense attorney’s spokesman said

 Todd Black said the comment he made to CNN Prime News host Mike Galanos on Wednesday night was edited and in reference to a comment made by Mike Brooks, another guest on the show.

“I said that in response to a former law-enforcement officer’s joke about Caylee,” Black said. “I have made the same comment to others in the last three weeks.”

Casey Anthony’s defense attorney, Jose Baez, has not returned calls to the Orlando Sentinel.

Larry Garrison, who represents Caylee Marie’s grandparents, George and Cindy Anthony, said Black’s statement was “an inappropriate uninformed comment. We are looking for Caylee alive and setting up a new tip line this week.”

A spokesman for Casey Anthony’s defense team told a national television news station that her young daughter, Caylee Marie Anthony, is dead.

Attorney Jose Baez’s spokesman, Todd Black, was live on a phone interview on CNN Wednesday night when he said, “It’s very difficult. This is a serious case involving not just the loss of the life of this little girl, but the loss of whatever is going to happen with Casey Anthony.”

Casey Anthony Receives First Visitor

 

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) — Casey Anthony, currently housed in a protective custody cell at the Orange County Jail, received her first visitor Wednesday night since she was indicted on a murder charge related to the death of her daughter, Caylee.

A jail spokesperson confirms that Casey’s attorney, Jose Baez, made an evening visit. Baez arrived around 8:20 p.m. and left about an hour later.

Casey has chosen to limit her video visitations to immediate family including her mother, father and brother. A jail spokesperson says that no video visitations have been scheduled at this time.

Exclusive Interview With George Anthony

 

 

SEMINOLE COUNTY, Fla. (WOFL FOX 35, Orlando) — George Anthony, the grandfather of missing toddler Caylee Anthony, took time out Wednesday to give an exclusive interview to Fox 35 reporter Holly Bristow.

Among the things he spoke about Anthony talked about the hour and twenty minutes he spent testifying before a grand jury Tuesday, the grand jury that indicted his 22 year old daughter, Casey Anthony, on a murder charge.

“That was the hardest thing for me to do,” Anthony said. “And, I’ve been through some tough things in my life.  That was the hardest thing I’ve had to do.”

Although legally Anthony can’t say specifically what he was asked, he did give a hint. 

“I talked about me being George Anthony on Hopespring Drive and his family” said Anthony.

And while he couldn’t revel the specifics of his testimony, he insisted that he felt he said nothing that could be used against his daughter. 

“Absolutely not, it’s all been out there, it’s all been reported,” said Anthony.  “I had nothing to hide (My) heart wide open and answered questions to the best of my ability, tough things to answer.”

Anthony admitted he had a rough time making it through the questioning.

 ”I broke down yesterday five times that I can remember,” he said.  “I broke down and it was hard to be composed.” 

Afterwards his attorney, Mark NeJame asked him if he wanted to make a comment to the media on his way out of court. Anthony said emotionally he wasn’t capable of doing it.

 So, why does George think he was the only member of his family asked to testify?  He has his theories.

“I think maybe past experience I’ve had,” said Anthony, referring to the ten years he spent as a homicide detective in Ohio.  He said that’s the same experience that makes him not believe what was presented to the grand jury. 

 ”To say they have certain things. I really can’t discuss what say what they have it I’ve asked them to prove it.  They can’t” said George.

Anthony said because of that doubt and because of what his gut is telling him, he will continue to search for his granddaughter.  Anthony said he’s confident little Caylee is alive and that she will be found.
