First-Degree Murder Charge

Casey Anthony was indicted today on seven charges in the disappearance of her missing daughter, Caylee Marie Anthony, including first-degree murder.

She also was charged with:

  • One count aggravated child abuse
  • One count aggravated manslaughter of a child
  • Four counts of providing false info to a law enforcement officer

Wesh.com Breakdown of charges:

The first count is for first-degree murder, a capital offense that is punishable by the death penalty. (State Attorney Lawson Lamar, however, did not say specifically he would seek execution, if Casey Anthony is convicted. He took no questions.)

This charge alleges that Casey Anthony caused the death of Caylee “from a premeditated design” between June 15 and July 16. Those dates correspond to the last time Caylee was seen and when she was reported missing. The indictment offers no other information on how, why or when.

 Count two is aggravated child abuse. This alleges that between the same dates Casey Anthony “did knowingly or willfully…causes great bodily harm, permanent disfigurement or permanent disability to Caylee Marie Anthony…by intentionally inflicting physical injury…or by intentionally committing an act or actively encouraging another person to commit an act which could reasonably expected to result in physical injury.”

Count three is aggravated manslaughter of a child. This count alleges that Casey Anthony caused Caylee’s death by failing to provide “the care, supervision and services necessary to maintain Caylee Marie Anthony’s physical and mental health” or that she did not make “a reasonable effort” to protect Caylee from someone else abuses, neglecting or exploiting her.

    I am SO HAPPY this cocky, prideful, slut b*tch is getting her due. She has grated the nerves of all right-thinking people following this case for far too long. I ALMOST felt sorry for her for a minute but right after seeing her dumb a** lawyers “press conference” I understood just why I hate her so much. She and he think alike – that somehow SHE has been done wrong. What the f*ck?? Go to jail you trashy ho bag, do not pass go, do not collect $200 – get your herpes infested, cold-blooded, inhuman, lower than dirt a** in jail and try to remain unseen. From what I’ve heard about prison, she better HOPE she gets lethal injection rather than time spent with the other inmates.

    That said, we still need to find Caylee’s body and give it a proper burial.

    GA did the unthinkable today, like his lawyer said, and has completely redeemed himself in my eyes.

    CA can go to hell, right along with her daughter.

    I hope the doofus lawyer loses his law license.

    Tonight, my gut is telling me that she is going to claim that she has been afraid to talk because of her fear of the wrath of her family. She will say she was an abused child and her actions were a direct result of her troubled childhood. She will play on the jury’s sympathy, because we all know she can’t claim insanity. She will describe how both Cindy and George were physically abusive, and she may throw in this co-dependence thing too.

    My gut could be wrong. Any other ideas? I mean, she really has no case, but what do you suppose they will try?

    Oh, Oh, Oh… Another scenario. She is afraid of her accomplice! She was afraid that if she told anybody, the accomplice would “off” her. The charges sort of hinted that there may have been someone else involved…

    Again, I’m just throwing ideas out there.

    Can anyone help me understand (logically) why an attorney would kick a news station out of a press conference based solely on the fact that someone who works at said news station hates Casey? How OLD is he? I do not understand the immature rationale. EVERYONE hates Casey – so why not kick all the news stations out?

    Boy, Amber, you’ve got that right. His PR firm is made up of a bunch of idiots as well. My heart really goes out to George. He is the only member of this family I can really relate to. The rest of them seem to deserve whatever they get, but George has my thoughts and prayers, as well as my sympathies in the loss of his baby granddaughter.

    I can’t work out her angle for wanting to defend herself. Everyone has a right to self-defense, although I am shocked that would be allowed in a capital case. I mean, if they require a minimal amount of experience with capital cases in a defense attorney, how could allow Casey, who has no legal experience to defend herself? Ted Bundy defended himself if I recall correctly, but at least he had a law degree. It must be that she cannot constitutionally be refused the right to defend herself.

    If the state goes for the death penalty and Casey is convicted, the appeal is automatic by federal law. If a licensed defense lawyer does a bad job, then the appeals court could order a new trial because of legal incompetence. But would legal incompetence apply if the defendant, who has no legal experience, exercises a constitutional right to self-defense?

    I don’t think it’s a matter of needing to defend herself so that the state will pay for forensic testing. If she has no money, she can request an experienced public defender at no cost to herself and testing that is necessary to defend her or for expert witnesses will also be paid for by the state (I am nearly 100% sure of that).

    So what’s her angle for defending herself?

    If she defends herself, will the state be prevented from keeping her in prison with no bond? She’ll need to depose witnesses (if she knows how), contact experts, possibly insist on examining evidence, possibly travel around.

    I’m not sure if a first degree murder charge in itself is grounds for no bond. I am not sure about that, but it is my understanding that bond can only be denied when a case can be made that the defendant is a flight risk (which could be partially mitigated by a GPS device) or if the defendant poses a substantial risk to the community. Other than worrying that she’ll kill witnesses (which would also be a risk with a manslaughter or second degree murder charge), she isn’t in the same community risk category as a serial killer, a rapist, or any other kind of violent criminal whose crimes were random.

    She can’t possibly think that she learned enough from Baez to defend herself in a capital murder case.

    Maybe she thinks the witnesses against her, who are largely her former close friends and family members, will be made completely uncomfortable and possibly reluctant to speak forthrightly if they have to face her directly instead of a lawyer representing her?

    Sources close to the Anthony family told Eyewitness News that Casey may choose to represent herself on the first-degree murder charge. Doing so would allow her to use taxpayer money to help pay for portions of the investigation. Attorney Jose Baez could remain available to her as a consultant.

    I think that it is only a matter of days before the body is found. I hope they look in a few other places, though, in addition to the airport locations. I think they should look at the cemetery near Sawgrass Apts. and also the place where one of her friends said that Casey used to hang out.

    I think she is a AWFUL AWFUL person and I want justice to be served but more than anything I want little Caylee to be found (just like I do of Madeliene McCann)
