Audio Of Secret Proceedings Mistakenly Sent In Anthony Case

ORLANDO, Fla. — Audio of a grand jury’s secret proceedings in the nationally-watched case of Casey Anthony was mistakenly sent outside the courtroom and to all media outlets plugged into the courthouse system.

“I don’t know what was listened to or what was heard until the time that it was turned off,” Orange County Chief Judge Belven Perry said. “Everyone who may have heard needs to govern themselves accordingly.”

Wesh.com Breakdown of charges:

The first count is for first-degree murder, a capital offense that is punishable by the death penalty. (State Attorney Lawson Lamar, however, did not say specifically he would seek execution, if Casey Anthony is convicted. He took no questions.)

This charge alleges that Casey Anthony caused the death of Caylee “from a premeditated design” between June 15 and July 16. Those dates correspond to the last time Caylee was seen and when she was reported missing. The indictment offers no other information on how, why or when.

Count two is aggravated child abuse. This alleges that between the same dates Casey Anthony “did knowingly or willfully…causes great bodily harm, permanent disfigurement or permanent disability to Caylee Marie Anthony…by intentionally inflicting physical injury…or by intentionally committing an act or actively encouraging another person to commit an act which could reasonably expected to result in physical injury.”

Count three is aggravated manslaughter of a child. This count alleges that Casey Anthony caused Caylee’s death by failing to provide “the care, supervision and services necessary to maintain Caylee Marie Anthony’s physical and mental health” or that she did not make “a reasonable effort” to protect Caylee from someone else abuses, neglecting or exploiting her.

Casey Anthony Charged With First-Degree Murder In Daughter’s Death

The Orange County grand jury indicted Casey Anthony on a total of seven counts: First-degree murder, aggravated child abuse, aggravated manslaughter and four counts of false statements to law enforcement

A first-degree murder charge means the grand jury believed the act to be premeditated. The punishment for such a charge is the death penalty or life in prison and no chance for parole.

Sources close to the Anthony family told Eyewitness News that Casey may choose to represent herself on the first-degree murder charge. Doing so would allow her to use taxpayer money to help pay for portions of the investigation. Attorney Jose Baez could remain available to her as a consultant.

Casey Anthony In Custody

ORANGE COUNTY, Fla. — Officials with the Orange County Sheriff’s Office said Casey Anthony was in custody Tuesday afternoon following an indictment on capital murder charges handed up by a grand jury less than an hour earlier

Casey Anthony was in handcuffs when she was led into the Orange County Sheriff’s Office around 4:40pm.

The Orange County grand jury indicted Casey Anthony on a capital murder charge Tuesday in the death of her 2-year-old daughter Caylee. The indictment was to remain sealed until Casey Anthony was under arrest. At that time, the specific charges will be released. Eyewitness News is awaiting that release and will have the details posted on WFTV.com as soon as we obtain them.

The indictment paved the way for sheriff’s deputies to arrest Casey and send her back to jail. She had been out on house arrest on child neglect charges and check fraud charges. The check fraud charges are in an unrelated case.

Casey Anthony Indicted!! Charges Sealed Until Her Arrest

ORANGE COUNTY, Fla. — The Orange County Grand Jury indicted Casey Anthony on a capital count Tuesday in the death of her 2-year-old daughter Caylee. The indictment has been sealed until Casey Anthony is taken into custody. At that time, the charges will be released

The indictment paves the way for sheriff’s deputies to arrest Casey and send her back to jail. She has been out on house arrest on child neglect charges and check fraud charges. The check fraud charges are in an unrelated case.

Caylee Anthony was reported missing by Casey earlier this summer, a month after Caylee first disappeared. Investigators said Casey has insisted she left the child with a babysitter and claims the babysitter must have Caylee.

However, deputies have not found that babysitter. They did find evidence in Casey’s car that shows Caylee Anthony’s decomposing body was in it. Caylee’s body has never been found.

Casey Anthony’s lawyer conceded earlier Tuesday that it was likely the grand jury would return some sort of indictment against his client in connection with the death of 2-year-old Caylee Anthony.

Orange County Sheriff’s Office Detective Yuri Melich, who has served as the lead investigator for the case, was the final witness and the Grand Jury began deliberations around 3:00pm. They returned from their deliberations less than an hour later.

Baez Made Statement At 1:30 p.m. With Casey

VIDEO:           Baez Holds Briefing

If the grand jury decides to indict Casey Anthony on homicide charges this afternoon, she will turn herself in to authorities, attorney Jose Baez said at his office.

Anthony stood next to her attorney, wearing a white collared shirt with a Where’s Caylee button, during the six-minute press conference.

She is doing her best to stand tall in front of everyone,” Baez said. “They [the sheriff's office] threw the kitchen sink at her a long time ago.”

Anthony, who has never appeared at a press conference, did not comment. She became emotional at times and shed a few tears.

“Casey is going through a nightmare,” Baez said. “She has a missing child. She is also someone’s child.”.

Casey stood next to Baez, crying. Baez also accused State Attorney Lawson Lamar of using the case to gain political favor in an election year. Baez said Lamar had made Casey “public enemy number one.”

“I want you to hear it straight from my mouth. These are my words. I understand that there is an election going on and I understand that those days are numbered and I understand that Casey Anthony is public enemy number one and that the State Attorney’s Office and the sheriff’s department is under a great deal of pressure to close this case,” Baez said. “I don’t think Lawson Lamar and I certainly hope that Lawson Lamar would not utilize a missing child to keep his job, so I’m not going to throw out any accusations. We all know what the situation is and if people want to conclude that, I’ll allow them to do so. But as far as straight up accusations, it is not coming from me.”

Baez then referenced the WFTV news team he kicked out of the conference while talking about Casey’s presence.

“Casey wants to be here and she has always wanted to speak, but she trusts me and will allow me to speak for her. There will be no questions or any blurting out of anything. If there is, of course, you will find yourself out in the parking lot with some other less respectful people. I won’t stand for any tabloid reporting or any cheap shots or lack of respect,” Baez said.

Baez PR Firm Releases Statement

State Attorney Lawson Lamar arrives Monday at the courthouse to testify before a grand jury.

Jose Baez’s public relations firm issued a press release Tuesday accusing State Attorney Lawson Lamar of using the case against Casey to win voters.

In Tuesday’s statement, Todd Black from Press Corps Media challenged the timing of Tuesday’s grand jury hearing stating: “There’s no time limit on bringing murder charges against any suspected offender. But, there is a limit on how much time Lawson Lamar has to impress voters.

Casey Spending Day At Attorney’s Office

Cindy dropped Casey off at Jose Baez’s office around 10:45am. Cindy left and then returned with paperwork, but neither said a word to reporters.

Casey Anthony was at her lawyer’s office in Osceola County on Tuesday afternoon and she could be enjoying her last few hours of the limited freedom she now has. She is a suspect in the death of her 2-year-old daughter Caylee, Caylee’s body has never been found.

Channel 9 reported that chloroform was found in the trunk of Casey’s car and jurors will hear how investigators found that potentially deadly chemical in the same spot where Caylee’s body had been at one point.

Casey and her mother, Cindy, left their east Orange County home Tuesday morning. She arrived at the office of her lawyer, Jose Baez around 11:00am. Even on a day when the Grand Jury is deciding her fate, Casey had nothing to say.

Casey appeared to be dressed more formally than normal, in pin-stripped slacks and a button-down shirt. There’s no telling if her attorney suggested that attire because of the possibility that she could soon be appearing in another mug shot.

One topic of conversation Tuesday might be who would represent her in a murder trial. Jose Baez does not meet the usual criteria for a lead council on a capital murder case, but there is a new attorney on the case, too, Jonathan Kasen out of south Florida. He could become the lead.

Of course, in the end, Casey can insist that Baez represent her. She just has to be told before the court that he’s unqualified.

As for a potential arrest Tuesday, Casey’s scheduled to be home by 4:00pm. If an arrest warrant is issued before then, Orange County could call Osceola County and ask that deputies pick her up at her attorney’s office or Baez could negotiate a surrender at the Orange County jail.
