All’s well. Power is just starting to come back on around town. We personally received no major setbacks, just downed tree’s that fortunately hit the ground not the house. I will still be out of pocket for most of the week as we are clearing and cleaning. Looks like a war zone down here. I’ll take some pics for everyone to see.
Thank you to the nancy team for keeping things running, and everyone else that has been commenting so that I can catch up on everything in short order.

Judge Denies HOA Request To Set Limitations For Protesters

Judge rules protesters can continue protesting outside the Anthony’s home
1:42 p.m. Orange County Judge Reginald K. Whitehead today denied the homeowners association request to keep protesters from yelling and gathering in front of the Anthony’s home. Whitehead wrote in his order that the homeowners association did not “give notice” as required by Florida law.

An attorney at Karen Wonsetler’s law firm, which represents the 127 members of the Chickasaw Oaks Phase 3 home owners association, said they did not provide a 3 days’ notice to the defendants named in the request for the injunction because “we simply do not know the names of the protesters. They are not gathered as part of an organization.”

There is no way we could have provided the required notice to John Doe and Jane Doe,” she said. “We knew this was going to be one of the difficulties.”

Wonsetler filed the request for a temporary injunction on Friday. The legal advisor said they asked Whitehead to waive the requirement. “He obviously did not,” she said.

The injunction sought to move the protesters to a vacant lot at the end of Hopespring Drive on Suburban Drive — hundreds of feet north of the Anthony’s home.

HOA plans ask judge to reconsider

 4:25 p.m. Karen Wonsetler – the attorney for Chickasaw Oaks Phase 3 homeowners association – said she plans to ask a judge again to issue an injunction to move the protesters several hundred feet away from the Anthony house.

Tonight, association members plan to hand out notices to protesters at the Anthony house about a hearing scheduled for Monday to consider the injunction.

This is the association’s attempt to notify the protesters about the request — a requirement under Florida law. A judge denied the injunction Tuesday, saying there wasn’t any notice given to the protesters.

1:18 p.m. Casey Anthony walked out of the jail with her attorney, Jose Baez, and is headed back to her parent’s home on Hopespring Drive. Two bodyguards accompanied Anthony as she left the Orange County Jail, equipped with her home confinement ankle monitor.

Anthony walked with her head up said nothing to reporters who shouted questions at her. Baez, the bodyguards and Anthony stepped into a red pick-up truck and left the jail. Media helicopters followed the vehicle.

Casey Anthony’s attorney Jose Baez walked into the Orange County jail before 8:30am Tuesday for bond hearing. The court appearance was for the new charges Casey faces, forging checks, fraud and petty theft. 

 

“A $1,000 on count one, $150 count two, $100 count three and no contact with the victim Amy Huizenga. You understand that Ms. Anthony?” Judge John Jordan asked Casey during the hearing.

 ”Yes,” Casey replied. 

The charges were brought on by Casey’s former best friend, Amy Huizenga. 

Casey and her attorney were only in court for about five minutes. Baez said re-arresting Casey and grandstanding are scare tactics.

Baez: Casey Has Been Prepared For The Worst

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) — In a media briefing Tuesday morning after Casey Anthony’s first appearance on new check fraud and theft charges, defense attorney Jose Baez questioned how police were handling their investigation into missing 3-year-old Caylee Anthony.

Baez said members of the Orange County Sheriff’s Office were making attempts to intimidate him and his client, Casey and said that games were being played in reference to her third arrest.

“I am not intimidated in any way, shape or form. If the state of Florida wants to play these games and waste your tax dollars and your resources, that’s for everyone to stand up for and complain about,” Baez said.

He was pleased with the sheriff’s office agreement to allow him to turn Casey into police custody instead of them arresting her at her home, causing unnecessary attention.

Baez cited Casey’s home confinement terms and said that police and the public know where she is and there is no need to draw anyone else toward the home off Hopespring Drive.

“She’s not going anywhere. She’s on house arrest for crying out loud,” he said.

He said in the hours he has spent with Casey in the past weeks, he has prepared her to be tough and to be ready to face whatever information investigators have.

“Casey has been prepared for the worst,” Baez said. “She won’t cave in.”

Baez questioned the media about “evidence leaked” on chloroform and DNA results from the Body Farm. He does not believe law enforcement has found anything substantial to convict Casey of anything other than check fraud and theft charges and says if they did have that evidence, they would have convicted her of it already.

He said he personally called the Body Farm in Tennessee who said their test results are not yet completed on air samples taken from Casey’s trunk.

Baez says he has requested that he be given information on evidence they do have so his own investigators can look at it. Baez does not believe police have any evidence of missing 3-year-old Caylee being either dead or alive, or what would have turned it over to him.

On the subject of officers making multiple arrests and the possibility of future arrests, Baez said police knew about the charges and had the information to charge Casey in July.

“They could have easily saved the taxpayers thousands of dollars by just filing it with the formal charges,” he said. “Officers are being wasted and could be on the street where they are needed.”

At the conclusion of Baez’s media briefing, he said he would have Casey out of jail within 24 hours.

Casey Anthony Faces Judge On New Charges

 

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) — Casey Anthony, mother of missing 3-year-old Caylee Anthony, appeared in front of an Initial Appearance Judge Tuesday morning on three new charges unrelated to the disappearance of her missing daughter.

The appearance occurred shortly after 9 a.m. and lasted about a minute.

Monday afternoon, her attorney escorted her to the Booking and Release Center to be jailed for the third time.

Casey was charged with uttering a forged check, fraudulent use of personal identification and petit theft.

The charges were filed by Casey’s friend, Amy Huizenga, who told police that Casey borrowed her car while she was in Puerto Rico and cleared out her bank account by using checks she accidentally left in the car.

Police obtained surveillance video that captures Casey using Huizenga’s checks at Target and Bank of America. Huizenga alleges that Casey stole approximately $700 from her bank account.

According to the jail, the Court Administrative Order required she be held in custody until her appearance which happened shortly after 9 a.m. Tuesday.

During her court appearance, a judge reviewed the probable cause of the charges and determined the bond amounts and any new conditions that may apply to the new charges.The bond amounts for the new charges total $1,250, and Casey could be re-released if her bond is authorized and posted. She will still be required to have Home Confinement Electronic Monitoring.

 

According to the jail, the earliest Casey could be released from jail would be late Tuesday afternoon due to paperwork processing.

Casey is currently behind held in Protective Custody Level One which prevents her from making contact with other inmates. She is being held in the women’s detention center in a cell by herself.

Casey’s attorney, Jose Baez, says he plans to have her out of jail in the next 24 hours.

Detectives Leave Fla. In Caylee Search; Officers Called To Home 42 Times

ORLANDO, Fla. — Detectives are leaving Florida Tuesday to search for missing Caylee Anthony as the child’s mother remains jailed.  An Orange County Sheriff’s Department official confirmed to Local 6 that investigators will be talking with possible witnesses outside the state for clues into the whereabouts of the child.

The move comes after the 3-year-old’s mother, Casey, was arrested, for a third time.  

Orange County sheriff’s deputies took Anthony, 22, into custody Monday as she visited the jail to meet with her case manager about other charges. 

Detectives have said lab tests show Caylee’s decomposing body was in her mother’s car, and Anthony is their only “person of interest” in the girl’s disappearance. 

42 Police Calls Since July 15

The Orange County Sheriff’s Office call log shows officers have been called to the Anthony home 42 times since July 15.

Deputies said 38 of the calls have been for disturbances, including a scene over the weekend when a mother brought her young children to the Anthony home late night. 

During the incident, a 9-year-old’s arm was slammed in a car door. 

The Department of Children and Families is investigating the child’s injury and why he was at the Anthony home at 12:30 a.m. on Sunday. 

Neighbors said aggressive protesters are becoming a safety hazard. The home owner’s association filed an injunction to try to keep the protesters away from the neighborhood. A judge could rule this week. About 100 families are expected to meet Tuesday night at a HOA meeting to discuss what options they have concerning the protesters.

Investigators plan trip to California

FOX 35’s Executive Producer Nicole Wolfe spoke with Leonard Padilla Tuesday morning. He is the celebrity bounty hunter that helped post Casey’s $500,000 bond when she was initially arrested.

Padilla says investigators from the Orange County Sheriff’s Office will fly to California to speak with him and his associates about their time spent with Casey while she was at home.

Specifically, Padilla says they will probably be interested in the story Casey told him about Caylee’s mysterious babysitter, Zenaida Fernandez-Gonzalez.

“She told us that she had gone to J. Blanchard Park and that Zenaida had taken the baby away from her and that Zenaida and her sister drove off in a silver 2008 Ford Focus model,” Padilla said.

Padilla says Casey added that Zenaida gave her a list of things to tell police for the next 30 days and scripted a statement for her.

“I don’t believe any of it,” Padilla said.

Casey told investigators in a sworn statement that the last time she saw her daughter was when she dropped her off at the steps leading to Zenaida’s apartment.

Police determined that the apartment had been vacant for months and that no one with the babysitter’s name had ever leased in the apartment complex.
